Abstract

The emergence of the Covid-19 virus at the end of 2019 caused various problems. One of them is related to criminal law enforcement in Indonesia. Criminal case trials as regulated in the Criminal Procedure Code are only conducted physically in court. However, because the Covid-19 pandemic is spread through droplets, physical encounters are avoided as much as possible to prevent transmission of the virus. In this regard, the Supreme Court of the Republic of Indonesia has issued a number of policies so that criminal trials during the pandemic can be carried out electronically by means of teleconferences. The policy starts from a memorandum of understanding (MoU), a circular letter, until the last one is PERMA No. 4 of 2020 concerning the Administration and Trial of Criminal Cases in Court Electronically. The enactment of these various policies raises questions regarding their suitability as a legal basis for electronic criminal proceedings according to Indonesian legislation. Apart from that, it is also related to its compliance with the principles of criminal procedure law in the Criminal Procedure Code. This research was conducted using two approaches, namely the Statute Approach and the Conceptual Approach. Which aims to analyze and provide an explanation of the proper legal basis for electronic criminal proceedings during the Covid-19 pandemic. In addition, it also analyzes the suitability of the provisions in PERMA No. 4 of 2020 on the principles of the Criminal Procedure Code
