Abstract

Asuransi jiwa di bidang telemarketing adalah suatu program asuransi dimana perusahaan asuransi memberikan pertanggungan terhadap kerugian yang menimpa jiwa seseorang akibat peristiwa tidak pasti, namun dalam pemasaran asuransinya dilakukan melalui alat komunikasi yaitu telefon. Jika ditinjau dari syarat sahnya perjanjian berdasarkan Pasal 1320 KUHPerdata, perjanjian asuransi jiwa bidang telemarketing adalah perjanjian yang legal karena perjanjian asuransi adalah perjanjian timbal balik yang bersifat konsensuil, selain itu kegiatan telemarketing adalah salah satu bentuk kerjasama pemasaran bancassurance berdasarkan Surat Edaran Bank Indonesia No. 6/43/DPNP. Keabsahan Voice Recording System sah berdasarkan Surat Edaran Otoritas Jasa Keuangan Nomor 12/SEOJK.07/2014 yang menyatakan bahwa pelaku usaha yang dalam penyampaian informasi menggunakan sarana komunikasi harus menggunakan alat rekam suara dan jika diperlukan hasil cetakan dari rekaman tersebut dapat dijadikan alat bukti yang sah dan dipersamakan dengan alat bukti tertulis yang ditandatangani oleh konsumen dalam persidangan. Hal tersebut juga selaras dengan pengaturan dalam Undang – Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik. Translation: Life insurance in the field of telemarketing is an insurance program in which insurance companies provide coverage for losses due to uncertain events, but the insurance marketing process is done through communication gadget, in example telephone. Based on validity of the agreement in terms of the requirements under Article 1320 of the Civil Code, telemarketing life insurance agreement is a legal agreement because the insurance agreement is a reciprocal agreement that is consensual, moreover telemarketing activity is one form of joint marketing bancassurance based on Surat Edaran Bank Indonesia No. 6/43 / DPNP. Validity of Voice Recording System is legitimate by the Financial Services Authority Circular No. 12 / SEOJK.07 / 2014 which states that the businesses are in the delivery of information using means of communication must use a voice recorder, and if necessary the printout of the recordings can be used as legal evidence and equated with written evidence signed by the consumer in the trial. It is also in line with the provision in the Law No. 11 of 2008 on Information and Electronic Transactions.
