Abstract

In its function as a means of protection, the rules of employment law should provide adequate protection for workers, including migrant women workers (TKW). However, empirical facts prove the occurrence of various violations of migrant workers rights as a reflection of ineffectiveness of the migrant workers protection system. Through the conceptual, historical and regulatory approach, this dissertation sought answers to the question of whether the existing provisions were adequate and, as the discussion objects are migrant workers, then the question is also how legal protection for migrant workers in the host countries established. This study is expected to identify weaknesses in the system of protection for migrant workers in both national and international law levels, and the results of this identification will be conducted the study to produce recommendations that should be benefited as an effort of legal improvement in this subject.
