Abstract

Land that has not quite made the transition registered deed under hand or with a binding sale and purchase agreement before a notary, so that less can be controlled by the Land Office, or by borrowing the name of the person who is domiciled in the local area. This is certainly cause a lot of problems, because on the one hand absentee land is prohibited. Prohibition of the absentee land ownership is not separated from the need for land is not known only in recent years but since human beings created by God and placed on this earth. In this thesis the author focuses on the sale and purchase of land absentee. Targets to be achieved in this thesis is the validity of absentee land purchase and legal protection for land buyers absentee. The study explains that during the absentee land is acquired based on inheritance, civil servants or the location of the border districts can be object of sale and purchase. it's just not happening during the transition has not been proved by a deed made by and in the presence of PPAT as Article 37 paragraph (1) PP. 24 of 1997. Absentee land purchasers obtain legal protection as a purchaser in good faith because of absentee land he had bought it from an inheritance, so get legal protection, because it does not include restrictions as set forth in the PP. 224 of 1961. If land rights are disputed that he had purchased, the buyer can defend it, or can be handed back to the land during the currency of the purchase price and expenses already incurred expenses refunded and that allows an increase in land prices.
