Abstract

Eksistensi “Prejudicieel Geschil” yang diterjemahkan sebagai suatu penundaan/penagguhan (schorsing) pemeriksaan suatu perkara akibat adanya “Perselisihan/Sengketa Prajudisial” sebagaimana diatur dalam Pasal 81 KUHP Jo. PERMA No. 1 Tahun 1956 Jo. SERMA No. 4 Tahun 1980, pada prinsipnya merupakan konkretisasi perlindungan terhadap HAM, khususnya hak tersangka maupun terdakwa.
