Abstract
Ciri pluralistik hukum waris di Indonesia masih sangat dominan, walaupun usaha untuk modifikasi tak henti-hentinya dilaksanakan. kehadiran Undang-undang Nomor 7 tahun 1989 yaitu undang-undang tentang Pengadilan Agama telah memberi penguat landasan yuridik eksistensi hukum waris Islam sebagai bagian dari positif dalam pewarisan. Dalam rangka mengarah kepada cita-cita unifikasi hukum setidak-tidaknya penyederhanaan hukum ingin ditemukan asas apa yang merupakan kebersamaan antara berbagai hukum waris tersebut.
