Abstract
This dissertation title, "The shift in the composition of the state unitary state of Indonesia”. The Philosophy composition according to the founding fathers of Indonesia is a strong unitary state, which still appreciate regions and autonomous regions are Special, and upholding the values of democracy and human rights by placing the People's Consultative Assembly (MPR) as the embodiment of the people who hold the sovereignty of the state. As a commitment to the goal of independent Indonesia namely social justice for all Indonesian people, the founding fathers had designed the Indonesian state administration system that is compatible with the objectives of the Indonesian state. After the changes of UUD NRI 1945, no longer putting the People's Consultative Assembly (MPR) as the embodiment of the people who hold the sovereignty of the state, which is an important foundation for the building of the Republic of Indonesia which is strong in achieving the country's goal to be realized, and of course it has implications for the change system of constitutional law, namely the existence of state institutions in carrying out its constitutional functions no longer watching, or responsibility of duties and performance as the previous era, given that there are adage "geen macht zonder verantwoordelijkheid" is no power without responsibility. Indonesian democracy has shifted from a representative democracy into a direct democracy. The spirit initiated in UUD 1945 by the founding fathers is not a direct democracy or commonly called a representative democracy is reflected in the precepts of Pancasila, even the founding fathers of modern democracy Indonesia has designed over constitutional system is not absolutism (power unlimited), and the state based on law, not based on sheer power. Post UUD 1945 changes also been a shift in the regional administration leading to the federal system, which can be seen in the rest of the delivery system to the local authority and the implementation of special autonomy and the flavors were led to the federal system. So, should the various efforts to increase the degree of decentralization, especially the provision of specialized and regional autonomy. Specialties, merely a commitment to realize the goals of the state, not only as a strategy to curb the various demands of the area or as absorbers separatist movements, but should step it should be awareness of hold firm commitment to achieve the purpose of the state is social justice for all Indonesian people, and still uphold the integrity of the Unitary State of Republic Indonesia.
