Abstract

This dissertation research analyzes three legal issues, namely : (a) philosophy of the principle of transparancy in payment system: (b) characterisitics of transparacy in electronic money transaction; and (c) regulatory implementation of principle of transparancy in payment system with electronic money in banking. Pursuant to the above-mentioned legal issues, this dissertation reserach is a legal research, by applying statute approach, conceptual approach and comparative approach. . Fairness was the philosophical base of the existence of transparency principle as market conduct in a payment system, which required an equitable treatment of rights and obligations in making efforts (level playing field) between organizers and consumers of a payment system service. Therefore, transparency should be sustained as the principle of legal protection for consumers of payment system service in a revised law of banking or the arrangement of payment system regulation. Relating to transactions with electronic money, the characteristic of transparency referred to the information of electronic money products’ and/or services’ profiles, in order to prevent lost for prospective and former holders while using them. The regulation of transparency tenet in national banking mentioned in regulation of Bank Indonesia (PBI) and regulation Financial Services Authority (POJK) was embodied by providing information and explanation on electronic money products and/or services to the prospective and former holders, both before, while, and after conducting a transaction with electronic money.
