Abstract
This article argues the effectiveness of death penalty on the improvement of justice system in Indonesia, and its potential violation toward the right on life of the prisoner. In the discussion, the writer urges the abolition of practices of death penalty and proposes three arguments to support her statement. First, the justice system in Indonesia has not yet succesfully showed independency, importiality and apparatus accountable. Second, there havent been any strong evidences as well as significant impact that the practice of death penalty plays role in decreasing the number of criminality in the country. Third, the practice of death penalty has indirectly rejected the concept of self redemption and rehabilitation on prisoners. This article reminds that the practice of death penalty should not be misused to legitimise vengeance towards criminals and criminality in the name of humanity.
