Abstract

Baby Blues Syndrome is a condition related to a mother’s mental health due to hormonal and life style changes after giving birth. People consider mothers who get mental disorders after giving birth is crazy, and they don't know mother with Baby Blues Syndrome who committed child abuse can be held criminal liability or not. So with many perspectives from the community, this research will answer the issue of qualifying Baby Blues Syndrome in Law Number 18 Year 2014 on Mental Health, so it will be known mothers with Baby Blues Syndrome who committed child abuse can be held criminal liability or not. This research is a type of normative legal research using a statute approach and conceptual approach. Two conclusions are obtained in this research: (1) Baby Blues Syndrome if it is associated with Law Number 18 of 2014 on Mental Health include to the category of People With Psychiatric Problems (ODMK); (2) Mothers with Baby Blues Syndrome who committed child abuse can be held criminal liability because they have an element of fault that is intentional. This research offers solutions (1) The implementation of a pre-marital certification program for prospective couple to be ready to marriage and have children; (2) Mothers with Baby Blues Syndrome who sentenced to prison must also get intensive care by a psychiatrist and the Integrated Service Center for Empowering Women and Children (P2TP2A) for the recovery process.
