Abstract

The development of the digital era in Indonesia has had a massive impact on various sectors of social life. One of the perceived impacts is on the economic sector. Now businesses can market their products through social media at a low cost. This digital age provides accessibility in increasing sales numbers of business people. The marketing of this product is done through endorsement services on social media by influencers on social media. Not only adults, now many children also become influencers who promote various products through social media and they got benefit from it. The purpose of this thesis is to determine the criminal provisions for users of endorsement services by children This study aims to determine the regulation of criminal acts of economic exploitation of children through endorsement services on social media. This research is a normative juridical legal research that links law as an effort to become the foundation in the implementation of various fields of life in society that can regulate order and justice. The research approach uses a statute approach and a conceptual approach. The type of research data is secondary data with primary and secondary legal materials. Based on this research, there is a legal vacuum in the application of crimes for perpetrators of economic exploitation of children through endorsement services on social media. The prevailing laws and regulations are considered to be less relevant to the problem of economic exploitation of children through social media arising in the digital era. In applying criminal regulations, judges can make systematic interpretations of several regulations regarding economic exploitation of children in deciding cases.
