Abstract
This research is motivated by the number of musicians who arrange other people's songs and/or music that means to boost their popularity. Arranging can violate the rights of the creator or copyright holder of songs and/or music because the arrangement is a derivative work. This research uses a conceptual approach, legislation approach, and case studies to find legal protection for creators and copyright holders of songs and/or music, as well as ways to arrange that does not violate the law. Based on the methods used, an analysis was produced that in arranging other people's songs and/or music, must have permission from the Creator, the Copyright Holder, and/or the owner of the Related Right to be protected as a Copyright. The intended permit is a license. The creator or holder of a song and/or music copyright has exclusive rights that include economic rights and moral rights to his work, so that when there are violations of these rights the creator or copyright holder can take legal action. Song and/or music copyright licenses, in general, are always associated with the obligation to grant royalties by the arranger to the creator or copyright holder of songs and/or music. The licensing agreement between the Author, the Copyright Holder, and/or the owner of the Related Rights with the arranger that has been registered in the general register of the Copyright license agreement has legal consequences to third parties so that when the arrangement works are used by third parties, the arranger is entitled to his exclusive rights. The role to manage the economic rights of song and/or music composers rests with the LMKN institution assisted by LMK. However, not all economic rights of the Author, the Copyright Holder, and/or the owner of the Related Right become the domain of LMK nor LMKN.
