Abstract

Komando Operasi Khusus Gabungan (Koopsusgab) TNI is an institution which created to support the main function of TNI in the prevention and eradication of terrorism. The involvement of TNI in dealing with terrorism has been regulated under the Law No. 15 Year 2003 jo. Law No. 5 Year 2018 on Eradication of Terrorism Crimes. The military function to deal with terrorism is the part of the main function of military operations other the war (OMSP) which must be based on Presidential Regulations and political policies. The authority of Koopsusbag TNI has caused public regarding the technical involvement of TNI in dealing with terrorism. Unrest the public concerns on what form of operations are used, and how was the responsibility for violations which done by TNI. This research analyses the limits of the authority of Koopsusgab TNI in the prevention and eradication of terrorism. The type of this research is normative research using statute approach and conceptual approach. The results of this research shows that the authority of Koopsusgab TNI in dealing with terrorism is the TNI's main function, as an assistance function of OMSP. The real form of this function is an arrest by TNI in a high escalation threat of terror. The arrest which done by TNI must be professional and based on the technical implementation. The orrest conducted by TNI must be inline with the technical implementation, otherwise the TNI must be responsible to their conduct based on the military criminal procedural code or the military criminal code.
