Abstract

This study aims to determine and analyze the validity and legal consequences of resaling of land and buildings that are controlled on the basis of PPJB to other parties based on applicable laws and regulations that are associated with two examples of cases related to this study. The type of research used is normative legal research using problem approach, which are statutory approach, conceptual approach, and case study. In this study, It is found that resaling of land and buildings controlled on the basis of PPJB often occured based on the transfer of rights agreement. However, in practical use, there are several rights transfer agreements that conflict with applicable laws and regulations so that the rights transfer agreement is null and void. If an agreement for transfer of rights is null and void, then the first purchaser is obliged to hand over the costs obtained from transfer of rights and obligations to third parties. The third parties have the right to claim compensation for acquired damages. So that an agreement to transfer rights can be implemented, it must be valid according to the legal conditions of an agreement.
