Abstract
The people are the most important element in a democratic country. Every policy formation, the government must involve the people. The process of involving the people in policy formation is called public participation. Participation can be done directly, or through representative institutions. Many laws and regulations in Indonesia regulate the process of public participation. However, there is no uniformity in laws and regulations regarding nomenclature and procedures. In its implementation, many policy formations have missed public participation. On the other hand, many people do not have the capacity to get the right to participate. Public participation can be strengthened by: harmonizing laws and regulations, establishing guidebooks, and arranging sanctions or legal consequences if participation is not implemented. Even though it is a dilemma, public participation must still be carried out.
