Abstract

The implementation of general elections in 2019 that be held simultaneously nationally, to elect the President/Vice President and members of the legislature is in the context of implementing the Constitutional Court Decision Number 14/PUU-XI/2013. However, in fact, the simultaneous elections have caused various problems. Seeing these problems, the Association for Elections and Democracy (Perludem) filed a judicial review of the Election Law which later resulted in the Constitutional Court Decision Number 55/PUU-XVII/2019. The purpose of writing this thesis is to analyze the ratio decidendi and the model of the general election system simultaneously after the Constitutional Court Decision Number 55/PUU-XVII/2019 on the implementation of simultaneous general elections in Indonesia. The Type of research used is legal research with a conceptual approach, a statutory approach, and a case approach. The results of the study state that the ratio decidendi of the Constitutional Court Decision Number 55/PUU-XVII/2019 confirms the existence of the Constitutional Court Decision Number 14/PUU-XI/2013. The holding of a five box election was not the only idea that was developed and debated during the amendments Constitution. The Court has provided six alternative models of simultaneous elections which are considered to remain constitutional. The more ideal model to be applied in Indonesia in the implementation of simultaneous elections in the future is the fourth model set out in the Constitutional Court Decision Number 55/PUUXVII/2019, namely national simultaneous elections to elect members of the DPR, DPD, President/Vice President, and several times after that local simultaneous elections will be held to elect members of the Provincial DPRD, Regency/City DPRD, election for the Governor and the Regent/Mayor. Regardless of which model will be applied for the next election is the authority of the legislators.
