Abstract

Fees on midwifes referral letter case often called as a referral gratification. The question arises because basically the fees in the case is transactional by nature that is the unique characteristic of bribery. The transactional character shows that there is a meeting of mind - a differential factor of bribery and gratification. Furthermore, the midwife in this case is not always qualified as a civil servant. This fact will hinder the use of bribery articles in UU PTPK because the articles stated civil servant as the subject. Basically, UU TPS can be applied, but in the condition when the referral letter meets the needs of the patient, it is really hard to prove the element ‘contradicting with the duties. Based on these problems, issues to be discussed in this research are (1) whether the articles of bribery applicable in the case and (2) what is the urgency of the private bribery concept in the case. This research is doctrinal research with the statute and conceptual approach. The conclusions are (1) the articles of bribery can be applied in the case and (2) the urgency of private bribery concept in the case is based on three arguments, i.e. (i) there is non-civil servant midwife, (ii) difficulty in applying UU TPS in the conditions when the referral letter meets the needs of the patient, and (iii) health sector is a public sector that runs into privatization.
