Abstract

Legislation on hazardous substances is one of the main issues in environmental law. This dissertation is concerned with the legislation on hazardous substances in Indonesia. In this dissertation, the notion of hazardous substances includes hazardous wastes. The legislation on hazardous substances in Indonesia is spread out and established in various regulatory regimes. The main characteristics of the current regulatory regimes are not integrated or synchronized, strongly emphasized on direct regulation and not explicitly based upon pollution prevention and precautionary principles. The Indonesian legislation have just recently applied strict liability to the use, manufacture and transport of hazardous substances by the enactment of the act Number 23 of 1997. However, the legislation on hazardous substances still lacks in the application of economic instruments, administrative and criminal sanctions which are necessary to apply to activities related to and persons involved in the use, manufacture, transport, treatment of hazardous substances including wastes. This dissertation suggests that Indonesia need to carry out reform in the legislation on hazardous substances which, inter alia, adopts an integrated approach, pollution prevention and precautionary principles, apply economic instruments. and create more various administrative and criminal sanctions
