Abstract

Sirtha, I Nyoman. The Social Significance Of Law in the Action and Interaction of Social Groups in the Amidst of Social Changes (Case Study of Subak Farmers in the Irrigation Area of Panaraga Giri Bali). The general aim of this research is to look at the interaction between the subak irrigation system based on the customary law and the technical irrigation system based on the state law in the development of irrigation. The specific aim is to develop the theory of the social significance of law in the middle of the pluralism of the law norms based on empirical data. The use of this research is to bridge the state law built by the authority and the customary law grown in the society, sothat both of the law norm can function effectively and the social significance to control the behaviour of the society. The research method used is the case study. The research was conducted in two areas, those are: (1) the area of the structure and behaviour of the executor of the law; (2) the area or culture and behaviour of the law users. The data analysis was qualitatively done by developing the theory based on the empirical data, inducvely. The result of the research shows that the social changes in the group of Subak society take place in the varieties of the levels, such as in the physical aspects, social systems, as well as in the cultural value, even though the spiritual value still becomes the soul of the Subak society in doing their various kinds of activities. If the interaction between the system of Subak irrigation based on the customary law and one based on the state law has the motive of opposition, then, both of the law norms contradict one to another, so that it is only one norm which functions effectively and has the social significance. If both of the law norms have the motive of cooperation, then, they become a harmonious combination so that they have the social significance to control the group of the society. The various norms of law such as the state law, the customary law, as well as the self regulation. function effectively so that they own the social significance 1n the various levels of life in the society, in accordance wi th the place, time and the situation of the particular go up of society.
