Abstract
Marriage between a citizen of Indonesia (WNI) and a stateless person is in fact a common thing occurs in Indonesia, where the marriage is permissible due to inexistence of regulations about the matter. Problems will emerge if the stateless person married to an Indonesian citizen, must be deported outside the territory of Republic of Indonesia which causes injustice regarding the consequences of the deportation, one of which is marital property. The legal issues that can be raised in this thesis are: (a) marriage between an Indonesian citizen and a stateless person has legal consequences for the spouse's marital property and (b) efforts to settle the marital property if the stateless person spouse is deported from Indonesia. This study used a doctrinal research method with a status approach, a conceptual approach, and refers to primary legal materials and secondary legal materials. Indonesian government are obliged to provide a solution if marriage between an Indonesian citizen and a stateless person occurs. The solution can be in the form of Government Regulation, or Regulation of the General Director of Immigration, or even Presidential Instruction. Observing from the example of the decision above, stateless persons are always aggrieved by ownership of assets during marriage and considering the position of their children or heirs. Therefore, the panel of judges must also pay attention to the rights of the children as heirs if there is request filed for isbat nikah. Material disadvantages to the children who are born from the unregistered marriage between Indonesian citizens and stateless persons must be prevented at any cost.
