Abstract
The essence of this dissertation is to seek rationality to put supervisory function as the main function of regional representative council rather as local regulation formulation function. There are four reasons underlying this idea; firstly, according to philosopher Jhon Stuart Mill, the main function of representative council is to conduct supervisory. Secondly, the daily routines function of representative council is supervisory function, not formulating local regulation function nor budgeting function. Thirdly, regional representative council is the conductor of local governance along with the local government. Therefore, regional representative council is actually the executive assembly. The true function of the executive is to run the rules not to make the rules eventhough it has competences to do so. Fourthly,Article 14 of Law Number 12/2011 on the Establishment of Legislation has defined the limits of local regulations made by the local government is only about local regulations in connection with implementation of regional autonomy and duty of assistance and to accommodate special local conditions and/or further elaboration of higher legislation.
