Abstract

The association of right is universal, every person, including labor. Setting the association of labour right should be able to create improved working conditions in an attempt to create social justice. Legal issues in this research include the need to guarantee the basic philosophical the association of labour right; the principle of the association of labour right and development of the association of labour right in Indonesia. The purpose of these legal issues are formulated to find inconsistencies in the formulation of norms of the association of labour right in Indonesia. In order to achieve the above goal, this research is normative research approach, the historical approach, statute approach and comparative approach. The results of this study is the presence of inconsistencies in setting the association of labour right in vertically and horizontally. The source of these inconsistencies are not maketh C.87 for consideration contained in Law 21/2000 konsiderans. Logical consequence, the right to form trade unions and the right to negotiate, not fully based on C. 87 jo. C. 98.
