Abstract
Land is the Gift of God for human to be cultivated, managed and utilized properly for the need of human life, in order to achieve the personal welfare or equitably social welfare. Thus, there will be a breach of social function of land and the philosophical aspect of land, if land owners ignore their social obligation to use and manage land properly and adequately. The Land Reform with the democracy, justice and sustainable principles can be a mechanism to obtain the welfare or prosperity related to the land. The regulation of the neglected land utilization and organization is chronological effect of the unsuccessful land reform which has been applied since 1960. The fail of land reform is likely affected by the lack of existing facilities and uncoordinated land policies. The fail of Land reform causes non utilization of land maximally affecting to the rise of neglected land. Government Regulation No. 11 /2010 and its implementing regulation seems one of supporting means for achieving social welfare on land. Therefore, it is important to integrate the land reform and other land policies. The legal basis for organization and utilization of neglected land is based on Government Regulation No, 11/2010 jo. The Regulation of National Land Agency No. 4/2011 and the Regulation of National Land Agency No. 5/2011. However, those regulations are not applied by several districts to implement the organization and utilization of neglected land. Consequently, there are many cases of the utilization of neglected land mostly related to the cases of the neglected land encumbered mortgages. Those problems of neglected land need to be further regulated
