Abstract

After political reform in 1998, there was a strong need to amend the constitution, i.e. the UUD 1945. One of the result is purification of the presidential system and at the same moment reducing the impact of executive heavy under the original constitution. Meanwhile, the political practice does not support this result. Politicians raised multy-party system under the proportional system of the general election for parliament. This dissertation examines the possibility of the legislature to run a policy called political party reduction, i.e. by limiting the number of political party to participate in the general election or to present in the parliament. Political party reduction is a solution for the incompatibility of the multy-party system with the presidential system. The issues to be discussed in this dissertation are the philosophical underpinning for political party reduction based on Pancasila as the groundnorm of the Indonesian legal system, the principles of law to justify the political party reduction and the regulation for political party reduction focusing on the establishment of the political party and on the general election for parliament. It can be concluded that political party reduction is a justifiable legal policy in order to strengthen the purified presidential system according to the amendment of the UUD 1945.
