Abstract
The title of this dissertation is “Legal Principles on Mangrove Forest Management in Order To Actualize Sustainable Development in Indonesia”. The existance of Mangrove forest as an integral part of ecosystem has been regulated in many regulations such as Law Number 5 Year 1990 regarding Natural Resources, Law Number 41 Year 1999 on Forest, Law Number 7 Year 2004 regarding Water Resources, Law Number 26 Year 2007 reg arding Spatial, Law number 27 Year 2007 regarding Coastal Areas and Small Islands, Law number 10 year 2009 regarding Tourism, Law number 32 year 2009 regarding Protection and Environmental Management, and as well Law number 45 year 2009. Nonetheless, such pack of regulations proved can not comprehensively protect Mangrove Forest in Indonesia. It shows from the data that to 60% of Mangrove forest facing destruction. Look at such critical problem of mangrove forest protection, this research address several question related to the issues, namely: (1) legal principle of mangrove forest management to actualize sustainable development in Indonesia; (2) the government and local government authorities in terms of mangrove forest management; (3) law enforcement instrument to achieve sustainable development. These three problems will be deep elaborate and analysis with using legal principle that contains in several regulation that correlate with natural resources, general principles of good governance, general principles of state management and general principle in law making process. In order to address the problem, furthermore, this research use legal research method with two approaches, namely: (i) normative approach and (ii) problem approach, which contain of conceptual approach, statute approach and comparative approach. In term support the mangrove forest management, this research recommends the needs of institutional restructurization related to mangrove forest management, therefore, the purpose of protection and management of sustainable mangrove forest can be achieved.
