Abstract
The objectives of the dissertation research are to reveal, analyze, and find out the principle of simple, quick and low-cost procedure law at the appeal court level, the principle of civil procedure law at the appeal court, and the characteristics of judicial verdicts at the appeal court which possesses a fixed legal power (in kracht van gewijsde) as an effort of limiting the number of cases brought into appeal to the Supreme Court in civil cases. The result of the study shows that the principle of simple, quick and low-cost procedure law has undergone a development from a traditional concept into a modern legal principle. The function of judex facti at the appeal court level was not able to overcome the high number of cases which proceed into appeal to the Supreme Court. Therefore, it is necessary to develop both judex facti and judex juris by which two types of the court appeal’s verdicts with different characters exist; that is, the verdict which has a fixed legal power and the verdict which has not yet possessed a fixed legal power. It is advisable that the procedure law reform should be performed at the appeal court level.
