Abstract

A crime classificated as crime of regional leader election, if that crime happened during for the election process between phase of preparation until phase planning by action. The rule of that crime, substantial regulation arranged in KUHP, General Election Act Number 12/2003 and also in President and Vice President Act Number 23/2003. The crime of regional leader election has a law sanction for criminal actor and has implication for process and electoral result validation. The law implication for criminal actor in by penal sanction, while for the process and electoral result validation is by administration sanction such as: temporarily or full stop of election, voting repeat, reenumeration voting result, losing right for vote until to cancellation as couple of regional leader. By procedure, the law enforcement of regional leader election crime have to reporting, studying and researching process by committe of election supervisor, and further continued to police for investigation. Whitout process by committee of election supervisor, the crime can not classificated as crime of regional leader election, but only usual crime that ruled by KUHP. After inspection procedure and the case taked over by police, the next procedure with KUHAP like the usual crime handeling, include how process of prosecution an court inspection. The procedure by KUHAP as a factor that chause a long time for law enforcement of regional leader election crime. While another side, the process of regional leader election has finished.
