Abstract

National development covering various aspects of human life, one of which is related to the need for a board, demand is closely related to land. In other words the existence of the land is very fundamental to the human and people's lives. Thus the importance of land to human life, in Indonesia it is stipulated in Article 33 of the Constitution of 1945 (hereinafter referred to as 1945) which is the legal basis for state control over land in a constitutional manner. Article 33 paragraph (3) of the 1945 Constitution affirms that earth, water, and natural riches contained therein is controlled by the state and used for the greatest welfare of the people. Every person has the right to possess the land and build a house to live. Civil servants as an element of the state apparatus in carrying out official duty to which it aspires, the state provided facilities such as home country (home office) to be occupied as long as he is still serving as civil servants. This occupied the home office, should not be converted to commercial interests, was limited to populated by civil servants because of the home office is the home state. During its development, civil servants who occupy official residence is the home office mengalihfungsikan is leased for commercial purposes such as boarding houses, where the photocopy, and so forth.
