Abstract

The legal relationship between the service user (bouwheer) and service provider (contractor) is necessary to facilitate the media, called the construction contract. This's in order to exchange obligations or performance of each party are framed through an agreement or contract that will be the parameters for the parties to act and not to harm and have the binding properties to the parties themselves since the signing of the agreement or contract. Construction contract in this regard was held by PT SABILLA SORAJA BATULICIN as the service user (bouwheer) and PT LIMA BINTANG JAYA ABADI as the service provider (contractor) associated with the construction of fuel depots. Construction contract must comply with legislation regarding the validity of the contract, whether the Burgerlijk Wetboek (BW) and the regulations relating to construction service. This construction work of the parties has performed as the legislation in force, that the parties are aware of their function in an orderly implementation of the construction and responsible for fulfilling the obligations of each are open to another in order to obtain their rights ; to carry out the responsibilities of the parties each with its own responsibilities based on the principles of professionalism, efficiency and effectiveness of the agreement or contract that agreed ; existence of harmony and balance between the parties in terms of the position of each party with the burden of work that is the responsibility of each, as well as maintaining relationship between each other even on the environment and surrounding communities. In this construction work involving private parties reached by direct appointment procedures for construction work held a complex construction jobs that require new technologies and to apply specific skills required. This construction work, the service provider (contractor) perform work independently stages with the knowledge and consent of service user (bouwheer) while still being based on good faith and it does not rule out its business ethics which can lead to fair dealing.
