Abstract

The author focuses on the cancellation of deed of sale made by the manufacturer's official land deeds and legal effect of certificate of land rights, so we can know the legal protection of purchasers of the disputed parcels of land and cancellation of the Deed of Sale and Purchase made by PPAT does not necessarily result in cancellation also has dibaliknama title deed into the name of the buyer. This research used a normative juridical to the statute approach, conceptual approach and case study. The results of this discussion is the purchaser of land rights has been qualified so that the material and formal sale and purchase is legally valid and the buyer obtain legal protection as a purchaser in good faith. Buyers have the right material on the land he had bought and could retain his rights from anywhere, so if landowners demanding that the certificates of land is returned, then the buyer the right to sue the seller to refund the costs have been incurred and the addition of value pricing and reimbursement requests expenses, damages and interest. Deed of Sale and Purchase which has been canceled by the Court, indicate a dispute over the rights of the disabled so as not to be juridical the BPN to cancel the certificate authority. This means, the cancellation of the Deed of Sale and Purchase by the District Court did not result in cancellation of certificate of land rights has been behind the name.
