Abstract

The transition of land rights are still often cause problems can not be separated from the base of the enactment of Law No. 5 of 1960 on the Basic Regulation of Agrarian Affairs, was based on customary law in accordance with Article 5, which determines that the agrarian law which applies to all land, water and space is customary, to the extent not contrary to national and State interests, based on national unity, with socialism Indonesia and with the regulations set forth in this Law and other laws and regulations, all things with respect to elements elements that rely on religious law. Some people still do not have proof of land ownership and if diverted enough deed of sale made on paper or a paper bearing the seal is witnessed by the chairman of the local community and still think that anyone who occupies the land area is considered as the land owner.
