Abstract

Need of the land for living often makes problem in the effort to comply with need of society. There is often breaking lang according to the owner, so neglect the rule which occur specifically fo providing housing area and residence which have environment opinion, such as street available, water, gutter and order public facilities. Therefore in the effort of land environment management, head of national agency land released regulation No.4 year of 1991 about land consolidation. The thing means to anticipate or avoid appearance unarrangement area even slum area such as area of this research in regency of Sidoarjo. So that, if the thing is let happen soto take in hand will be more difficult from a lot aspects. Purpose of this research to examine the things base on law relation that appear from the caretaker namely National Agency Land (BPN) with consolidation participants so appear right and abligation, among parties. The supporting factors and obstacles to run consolidation in location. This research is law research through using of statue approach, conceptual approach and case approach. The law materials are collested, identified and taken inventory, analyzed methode by descriptive analysis. The result of this research which bases law relation between caretaket (BPN) and consolidation participants of city land is presence determinate of land consolidation with approval that started by participants approval to release right and their land and run land consolidation program agree with the regulation. Approval which happens contain court of justice substance that is section 1320, 1338 clause 1 , 1339 BW and public law substance. The thing can be investigated that the agreement is done by the party who has authority (BPN). In a substance manner managed in the regulation head of National Agency Land, and procedural. The supporting factor to be done is participants get value added an an economic manner, environment can be arranged orderly and healthy, have the certainty law through published certificate. The obstacle factor that is lack of information, lack of purpose understanding and useful of consolidation and land contribution for developing and cost which must be guaranted by participants.
