Abstract

This study aims to find out the construction of ideology in the Draft Bill of Penal Code: Adultery, Fornication, and Cohabitation; and Lewd Acts (RKUHP: Zina dan Perbuatan Cabul). Fairclough’s Critical Discourse Analysis is applied in this study to reveal the ideology that is constructed, and it is supported by the explanation of the language of the legal discourse to help the writer examine the language features in the textual analysis. Through this study, it is found that zina and perbuatan cabul are classified into: adultery, fornication, and cohabitation; and lewd acts. Those terms refer to the illegal sexual intercourse, because any sexual activity is legal only for a man and a woman who are in a legal marriage relationship. By proposing the Draft Bill of Penal Code: Adultery, Fornication, and Cohabitation; and Lewd Acts (RKUHP: Zina dan Perbuatan Cabul), the government is trying to construct the ideology of Pancasila in point one: Ketuhanan Yang Maha Esa – especially in item 1: Indonesian believe and devote to the One Almighty God; and in item 2: Indonesian people believe and devote to the One Almighty God as their religion and belief according to justice and civilized humanity – as the basic principal to be implemented as the way of life of Indonesian people. It is also the basic principle why the Draft Bill of Penal Code: Adultery, Fornication, and Cohabitation; and Lewd Acts (RKUHP: Zina dan Perbuatan Cabul) is proposed.
