Abstract

This study tells about the Status of the Ownership of the House Which Stood On the Sea. Increasing number of Indonesian population resulted also increased the need for dry land to the place of residence, however the geographical condition of Indonesia which is mostly in the form of the waters of cause there are people who build a house and reside in the territorial waters one of it is the sea. The ownership of the house which stood on the sea, based on Article 139 and Article 140 of Law No. 1 Year 2011 about Housing and Settlement Area, that mention about the ban on residential building in the outside area which is specifically for housing and settlements as well as in a place that can potentially pose a danger to people and goods. So the construction of the house above the sea can not be done because it is not in accordance with national law. Proof of ownership of the house over the sea different with proving the ownership of the house above the ground. This is because in the construction of houses on the land meets the requirements of the administration which is based on article 8 paragraph (1) of law No. 28 of 2002 on Building, where the terms of the Administration regarding the terms of the status of land rights, the status of ownership of building, and building permit. While the construction of houses on the sea, does not meet the requirements of administration, so a house on the sea can not be published proof of ownership.
