Abstract

Legal issues studied in this dissertation are (1) the philosophy of examination in the use of governmental authority, (2) principles of law as a examination ground of governmental authority, and (3) the competent institutions conduct examination of the use of governmental authority. This study is a normative with statute approach, conceptual approach, comparative approach, and case approach. Reseach result give answer that philosophie of the examination of governmental authority with regard to the rule of law principle is the basis of government action as the concept of administrative law. The principles in the examination use of governmental authority, among others, the principle of legality, the principle of specialitas, the principles of proper administration, the principle of the protection of human rights, the principles of good governance and the principle of reasonableness. Through these principles, the examination of the APIP, the Ombudsman, the Administrative Court, and the Audit Board of the Republic of Indonesia to examination and used as bases of criminal law
