Abstract

Land is the main facility to support the development of infrastructures in each region. There are many benefits of land which may causes legal issues that affect the land owners. PT Pelindo III as a port business entitiy and state owned company has an important roel for managing the port businesses especially for utilization of land as a HPL. The status of legal entity owned by PT Pelindo III becomes interesting to be studied for this research is regarding the limitation of authority of PT Pelindo III for its land management efforts against third parties as the land user and the responsibility of PT Pelindo III to the government for granting of the HPL of the port. PT Pelindo III as a state owned company, receive a lot of authority for example is for managing the port land in accordance with its function. To enhance the value of the land function, PT Pelindo III may grant its authority to third parties through an agreement as HPL. It can be use to for utilization in order to increase the value of the land. Furthermore, it has many problems between PT Pelindo III and the third parties due to many of third parties argue that the authority of the land is dedicated from the port authority. However the society opinion is not totally wrong because in the government rules there are some rules that is formed in multiple perspective related to the port authority. The responsibility of PT Pelindo III is to manage the land in accordance with its allocation by conducting area by zonation. Hence, PT Pelindo III also obliged to pay attention to the environment of adequate public facilities around port area. Inshort, the responsibility of PT Pelindo III is focus in not only gaining the company income but also supporting the development of society around the port area.
