Abstract

This research is purposed to analyzing the constitution rule that linked with Fiducia, especially whose organizing the registration and its law consequences and also protection to its parties. This normative law research using constitution rule approach that linked with Fiducia. From this research is got that the receiver of Fiducia who has been registering Fiducia guarantee object properties to the Fiducia Registration Office are getting “right to precede”, that is a right to get paid from its claim by selling the Fiducia registration Office are getting “right to precede” that is a right to get paid from its claim by selling the Fiducia guarantee object properties if the publisher of Fiducia cannot accomplish their obligation which have been agreed at the agreement. Law protection of Fiducia Guarantee constitution is given by the parties (publisher dan receiver of Fiducia) and the buyers of commodities stock who pay off to the Fiducia Guarantee object properties and also to another credits. Keywords : Fidusia is transferring of property right trustedly as debt guarantee from the publisher of Fiducia to the receiver of Fiducia, where as the physical property are still authorized by the publisher of Fiducia by borrow – use tie.
