Abstract

In the area of drug distribution in Indonesia, there is a body in charge of overseeing, named Badan Pengawas Obat dan Makanan. The function of Badan Pengawas Obat dan Makanan is mentioned in Article 3 paragraph (1) of the Regulation of the Drug and Food Control Agency number 26 of 2017 including in the letter "(c) preparation and stipulation of norms, standards, procedures, and criteria in the field of supervision before being circulated and supervised during circulation, and in letter (d) implementation of supervision before circulation and supervision during circulation ”. In Article 2 paragraph (1) of Presidential Regulation number 80 of 2017 it is explained that "BPOM has the task of carrying out governmental tasks in the field of Drug and Food supervision in accordance with statutory provisions." With the existence of such duties, it is a responsibility for BPOM to handle products medicinal products circulating in the community. The circulation of candy with tadalafil content in the community needs a serious attention by BPOM. The product that is circulating in the community is closely related to the distribution permit. The product that has not been registered to BPOM because it is not listed in the list of drugs that already have permission from BPOM by the manufacturer or importer of the product and must be examined the legal status of the product. This study tries to explain the legality of candy products with tadalafil and the extent of BPOM's responsibility for the circulation of these products.
