Abstract

Every human being needs a house or a place to live to maintain their life. The high public demand for housing or residences is an opportunity for developers to make a profit. The number of disputes over the practice of buying and selling houses, one of which is the Contract on Binding of Buy and Sell House which is a standard contract. The contract that has the clauses that prohibited from being included in a contract. Most of the clauses of the contract are detrimental to the consumer because of the imbalance of rights and obligations between the parties made unilaterally by the developers, then the position of the consumer is weak because they cannot negotiate with the developer. Due to the indecisiveness of the existing rules in Indonesia, there are still many uses of standard clauses whose contents contradict the laws and regulations so that there are still many consumers who do not get legal protection due to wrong in applying the law or in filing a lawsuit. This research is a legal research with the methodology of statute approach, conceptual approach, and case approach Therefore it need a rule that explicitly prohibit the inclusion of standard clauses. So that, there is no misuse or irregularities in drawing up the agreement.
