Abstract

Kemajuan teknologi informasi mendukung pemanfaatan intenet. Internet tidak hanya sebagai media penghubung dan media komunikasi tetapi juga sebagai media penunjang bisnis. Hal ini berdampak pesatnya perkembangan online shop di Indonesia. Dalam perkembangannya, muncul berbagai macam sistem jual beli melalui online shop antara lain yang sedang marak adalah pre order dan dropshipping. Masyarakat luas masih belum mempunyai pengetahuan mengenai sistem-sistem baru yang muncul saat ini. Selain mempunyai banyak keunggulan, jual beli melalui online shop juga mempunyai dampak negatif yakni timbulnya permasalahan hukum yang akan menimbulkan kerugian bagi konsumen. Saat ini kedudukan konsumen sangat lemah karena dipengaruhi beberapa faktor antara lain tingkat kesadaran dan tingkat pendapatan yang relatif rendah. Mayoritas penduduk di Indonesia adalah pemeluk agama Islam, oleh sebab itu perlu diketahui bagaimana keabsahan jual beli melalui online shop dan perlindungan konsumen menurut hukum Islam. Dalam Hukum Islam dikenal salah satu jenis jual beli yaitu Transaksi As- Salam, dimana secara umum pada prinsipnya transaksi As-salam dapat dianalogikan sama dengan jual beli melalui online shop. Persamaan tersebut antara lain dalam hal penyerahan harga yang disegerakan dan penyerahan barang yang ditangguhkan. Translation: Technological leap in recent years has resulted in greater utilization of internet. Internet has become not only as medium for communication, to get people connected, but also as business instrument. This very development has culminated in great advancement of so called ‘online shop’ in Indonesia. The last few years saw the emergent of several trading system through online shops, two of those are pre-order and dropshipping. The problem is, public seems not able yet to cope with these new systems. Though encompasses many advantages, online shop surely has its downsides—for consumer, this includes legal implication that could harm their rights. Nowadays, consumers hold relatively weak position; this is well influenced by low awareness and low income level amongst them. Since the majority of Indonesians are Muslim, it is important to know whether online shop is legal or not and what protections does consumers get based on the Islamic law. Within the boundary of Islamic law, we recognized that online shop shares similarities with what is mentioned as As-Salam transaction. Similarities include early payment and late shipping of the goods.
