Abstract

The state capital is the city where the seat of the central government of a country is gathered, the administrative elements, namely the executive, legislative, and judiciary. The Indonesian government plans to move the nation's capital city from Jakarta to Kutai Kartanegara Regency, East Kalimantan. The relocation of the capital city is based on the burden of Jakarta's getting heavier, one of the consequences is environmental pollution that occurs. Environmental pollution that occurs in Jakarta has passed the environmental threshold. The relocation of the capital city to Kutai Kartanegara Regency will have a significant environmental impact because infrastructure development will take place in all sectors to support the infrastructure of the new capital city. The research method used is fundamental research through conceptual and statutory approaches to assess existing legal problems. The purpose of this research is to study and analyze the government's responsibility in protecting and managing the environment for relocating the country's capital city. The results of this study indicate that moving the nation's capital will have implications for the environment in the Kutai Kartanegara Regency. The responsibility of the government, especially local governments, is to provide environmental protection and management to areas that will become the capital of the new state. There are legal remedies that can be made including through administrative efforts such as filing objections, preventive and repressive protections and imposing sanctions in the form of fines and imprisonment if they violate or are not in accordance with the sustainability and welfare of the local community.
