Abstract
Mekanisme penyelesaian sengketa dagang di ASEAN sebelum terbentuknya Piagam ASEAN 2008 diatur dalam ASEAN Protocol on Enhanced Dispute Settlement Mechanism (the 2004 Protocol), dimana segala sengketa dagang diselesaiakan dengan cara-cara damai sesuai pasal 33 Piagam PBB dan diteruskan melalui panel apabila cara damai tidak berhasil. Namun, setelah Piagam ASEAN 2008 terbentuk sengketa dagang di ASEAN berdasarkan pasal 24 Piagam ASEAN 2008 tetap diatur berdasarkan ASEAN Protocol on Enhanced Dispute Settlement Mechanism (the 2004 Protocol).
