Abstract

Barat adalah terbitnya SK Bupati Lombok Barat 2134 A/28/Adm.Pem/2009 tertanggal 30 Nopember 2009 tentang Pembentukan Panitia Pengadaan Tanah di Kabupaten Lombok Barat yang menyebutkan bahwa Ketua Tim Pengadaan Tanah dipegang oleh Sekda Kabupaten Lombok Barat. Pemberian ganti rugi tanah yang terkena proyek tersebut juga mengalami hal yang menyimpang dari ketentuan yaitu nilai jual yang melampaui NJOP (Nilai Jual Obyek Pajak) dan dibayar sebelum pembebasan dilakukan. Proses pembayaran tersebu ada beberapa kejanggalan sehingga timbul gugatan perdata di Pengadilan serta masih ditemuinya sengketa yang seharusnya penyelesaian pembayaran dititipkan melalui Pengadilan Negeri tetapi ini tidak dilakukan. Hasil pembahasan dalam penelitian ini adalah bahwa pembangunan proyek jalan Bandara Internasional di Kabupaten Lombok Barat termasuk pengadaan tanah untuk kepentingan umum sesuai dengan ketentuan Pasal 5 Perpres No. 65 Tahun 2006 sebagaimana diubah dengan Perpres No. 36 Tahun 2005. Sebagai pengadaan tanah untuk kepentingan umum, maka pengadaan tanahnya dilakukan melalui pembentukan Panitia Pengadaan Tanah Kabupaten/Kota yang pembayaran ganti kerugiannya didasarkan atas musyawarah, yang berarti menghormati hak atas tanah dan pemegang haknya. Cara penetapan ganti rugi atas pembebasan tanah tersebut telah dilakukan sesuai dengan prosedur yang benar yaitu pemegang hak atas tanah berpedoman pada harga pasar tanah, sedangkan Panitia Pengadaan Tanah Kabupaten/Kota berpedoman pada Nilai Jual Obyek Pajak (NJOP) Besarnya ganti rugi yang ditawarkan oleh instansi Pemerintah yang memerlukan tanah dinilai terlalu rendah dan tidak layak. Akibat hukum pelepasan hak milik atas tanah akan hapus dan kembali menjadi tanah yang dikuasai oleh negara dan pihak yang menbutuhkan tanah untuk kepentingan umum tersebut mengajukan permohonan hak. As the procurement of land for public use, then the provision of land is done through the establishment of the District Land Procurement Committee / City the settlement payments based on consensus, which means respect for land rights and rights holders. Way of determination of compensation for land acquisition has been carried out in accordance with proper procedures that holders of land rights based on market price of land, while the Land Acquisition Committee of the District / City based on the Tax Object Sale Value (NJOP) The amount of compensation offered by Government agencies which requires the land is considered too low and not worth it. Due to release legal rights to land will be removed and returned to the land controlled by the state and party the land for public use
