Abstract

Manusia Sebagai makhluk sosial tentu tidak lepas dari hubungan dan interaksi dengan manusia lainnya. Status sosial inilah yang menjadikan teknologi komunikasi dan informasi menjadi sektor terpenting dalam perkembangan kehidupan manusia. Kemajuan teknologi komunikasi dan informasi dewasa kini telah membawa perubahan besar terkait perilaku dan cara komunikasi manusia dengan sesamanya. Manusia yang dulu melakukan komunikasi secara langsung, kini beralih berkomunikasi dengan bermacam media yang salah satunya adalah Internet. Internet telah membawa manusia menuju dunia yang tidak terbatas. Sebagai hasil inovasi dari internet yaitu www.facebook.com merupakan sebuah situs jejaring sosial yang kini paling digemari oleh banyak masyarakat. Perubahan ini selain membawa dampak positif, ternyata juga mambawa dampak negatif. Tindakan kejahatan serta pelanggaran norma sering kali dijumpai ketika manusia melakukan aktifitas komunikasi dan berbagi informasi di situs jejaring sosial facebook. Salah satu bentuk kejahatan tersebut adalah penyalahgunaan foto orang lain di www.facebook.com. Sebagai salah satu ciptaan yang dilindungi menurut undang-undang Hak Cipta, dalam berekspresi khususnya ketika menggunakan foto orang lain, masyarakat harus memperhatikan batasan-batasan yang ada. Undang-undang ITE atau yang disebut sebagai cyberlaw Indonesia telah meberikan batasan-batasan terkait bagaimana masyarakat dalam berkomunikasi dan berbagi informasi yang baik di dunia cyber (dunia dimana kita beraktifitas menggunakan internet). Sejatinya Kebebasan manusia dalam berekspresi adalah hak manusia yang dilindungi oleh undang-undang. Namun manusia hidup di dunia ini berdampingan dengan manusia lainnya. Sebagai konsekuensinya, manusia harus bisa mempertanggungjawabkan hasil ekspresinya ketika hal tersebut bergesekan dengan hak orang lain. Negara sebagai penjamin keamanan dan hak warga negaranya mempunyai peranan yang sangat penting. Pengawasan serta Penegakan hukum yang tegas diperlukan untuk menjamin keamanan dan kenyamanan masyarakat dalam bereskpresi khususnya di situs jejaring sosial www.facebook.com Translation: Humans as social beings is certainly not out of the relationship and interaction with other human beings. Social status is what makes communications and information technology become the most important sector in the development of human life. Advancement of information and communication technology has now grown to bring major changes related to human behavior and ways of communication with each other. Humans are used to communicate directly, now switch to communicate with a variety of media, one of which is the Internet. The Internet has brought man into the world is not limited. As a result of innovation of the internet, namely www.facebook.com is a social networking site that is now the most favored by many people. These changes are in addition to a positive impact, it also takes the negative impact. Crime and violation of norms often encountered when people perform activities of communication and sharing of information on the social networking site facebook. One form of this crime is the abuse of other people's photos on www.facebook.com. As one of the creations that are protected by the laws of Copyright, in its expression, especially when using a photograph of another person, society must pay attention to the constraints that exist. ITE law or the so-called cyberlaw Indonesia has gave the restrictions related to how people communicate and share information both in the cyber world (the world where our activity using the internet). True human freedom of expression is a human right protected by law. But man lives in the world side by side with other human beings. As a consequence, people should be accountable for the results of expression when it is rubbing against the rights of others. The state as a guarantor of security and rights of its citizens have a very important role. Supervision and strict law enforcement is required to ensure the safety and comfort of the people inside of expression, especially in the social networking site www.facebook.com.
