Abstract
Peer-to-peer lending is a fintech financial product where lenders (lenders) meet with borrowers (borrowers) on platforms provided by service providers in an electronic system or P2P Lending provider as regulated in POJK Number 77/POJK. 01/2016. P2P Lending provider offer a variety of loan products that the public can choose according to their needs, one of which is Invoice Financing. In the legal construction of the Invoice Financing product, there is 1 (one) party involved, namely the payer. This will raise new questions regarding the legal relationship between the payor and other parties in P2P Lending such as borrowers, lenders and P2P Lending provider. Then, if the invoice is used as loan collateral in the Invoice Financing scheme, then the invoice must be executed to pay off the borrower's obligations. This study was conducted to analyze the legal relationship between the parties in Invoice Financing and the accountability of P2P Lending provider in Invoice Financing. This research is a normative research using statute approach, conceptual approach and case study. The results of this study indicate that the party who has a legal relationship with payor is only the borrower and the claim is used as collateral not in the sense of a guarantee that is bound by a guarantee agreement. In this case, the P2P Lending provider may also be responsible for the negligence he/she did which resulted in a loss to the other party. This research is expected to be a reference for academics and practitioners in the implementation of invoice financing in Indonesia.
