Abstract

Notaries are independent public officials and the task of the Notary is as an outside party who regulate and get evidence from the parties and further to be stated in a deed that will have autenticity value. In practice, many Notaries are coorporating with other parties such as banks, service providers and developers. This action of Notary coorporating with other parties does not rule out the posibility of a violating the rules in the Notary Act and the Notary Code of Ethics. This research is legal research that uses a statutory approach and a conceptual approach. This thesis discusses the characteristic of a Notary in corporating with other parties, in this thesis also discusses the legal consequences of a Notary who acts in coorporation with other parties. The result of this study state that the Notary coorporation with other parties is not accordance with the principle of independency in the Notary Act and the Notary Code of Ethics, then the coorporation is invalid and there are administrative sanctions that can be imposed on a Notary concerned. Therefore, it is hoped that Notaries will be more careful in carrying out coorperative action with other parties and the need to improve the enforcement of Ethics by the Indonesian Notary Association (INI) to minimize the occurrence of what is done by Notaries in carrying out their positions in coorporating with other parties.
