Abstract
The purpose of this study is to examine the regulations on agricultural land owned in absentee, whether it can still be applied in Indonesia today. Apart from that, the purpose of this research is to be able to provide a proposal so that regulations regarding the ownership of agricultural land can be owned in one district/city, as long as the owner's source of livelihood comes from the cultivation of the land, and the agricultural land is still managed actively, as instructed by the government. For the implementation of the five agrarian reform programs in the UUPA, TAP MPR RI IX/MPR/2001 mandates agrarian reform and natural resource management to reviewland regulations absentee. After six decades since the law was enacted, the relevance of the law and all its implementing regulations to the current situation and condition of Indonesia is now being questioned. Considering that the law was formed with a legal ratio, the situation and conditions in Indonesia at that time were much different from the current conditions. So that the program land reform regulates the prohibition of and ownership absentee. Therefore, the legal issues taken are: Is the ratio legis the limitation of absentee land in one sub-district? And is it still relevant if the regulations regarding absentee land in one sub-district are still enforced with the current situation in Indonesia? The method used is normative juridical using empirical data using a statute approach and a conceptual approach. The results of this study indicate that agricultural land ownership regulations should be relaxed up to the district/city level so that the laws and implementing regulations related to absentee land should be updated or repealed with the new law.
