Abstract

This research has two main issues, (1) Legislative ratio determination of Officials/Institutions authorized to issue evidence as heirs according to the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency Number 16 of 2021; and (2) Unification of the authority of the official/institution that issues evidence as heirs with legal certainty. This research is a normative juridical research conducted by researching library materials consisting of primary legal materials and secondary legal materials. The approach used is the statute approach, conceptual approach and case approach. The results of this study that (1) the legislative ratio of appointing Officials/Institutions authorized to issue evidence of heirs according to the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency Number 16 of 2021 is to provide convenience for people who need evidence as heirs. (2) Unification of the authority of the official who issues evidence as heirs can be reached through the delegation of authority by the government to other government agencies, namely the Office of Population and Civil Registration. Because inheritance is part of the law of people whose administration has been the duty of the Office of Population and Civil Registration.
