Abstract

"A birth certificate is a proof that contains the identity of each child, as well as a guarantor for the fulfillment of a child’s rights by the State. This certificate also serves as an authentic evidence of a child's origins and acts as the basis for the legal relationship between parents and a child, giving rise to rights and obligations for both parties. One of these rights that arises from the existence of a birth certificate is inheritance rights. Any discrepancy existing between the information in the certificate and the actual facts will lead to future problems or disputes, rendering the birth certificate defective. A birth certificate in which there is a substance defect can be subjected for cancellation. Such cancellation of birth certificate has an impact on the inheritance rights. This normative legal research implemented statute approach, conceptual approach, and case approach. This research discussed the cancellation of a birth certificate in which there is a substance defect. In addition, the legal consequences of canceling birth certificate on a child’s inheritance rights are also discussed. The research results revealed that a birth certificate containing substance defects can be subjected to cancelation through the Court or without the Court. In addition, the cancellation causes the child to lose inheritance rights due to the destruction of the legal relationship between the parents and the child as stated in the birth certificate. Therefore, it is advised that the Government or the Department of Population and Civil Registry to provide counseling related to the consequences of creating birth certificates that are not in accordance with the legal facts."
