Abstract

The aim of this research are the first is to find the similarity and the differentiation in bank foreign investment regulating in Indonesia and Malaysia; the second is to discover the caracter of bank foreign investment regulation in Indonesia and Malaysia. Problem approaching of this research is to solve the legal issue which occured in this legal research. This approach is to be used in examining on the banking foreign regulation in Indonesia and Malaysia, then following by interviewing bank and foreign investment specialist prior to the qualitative method. The history of banking foreign investment in Indonesia demonstrates that the regulation needs to develop and requires a point of reference from another country that has already had a better system in banking foreign investment. The reason of researcher to prefer Malaysia as a study is that non-technically Malaysia has been agresively developed the regulation and the investment itself to other country more than Indonesia.
